Your client's CGL policy covers all their known locations but during the policy year they start using other locations and forget to tell you.  Are those locations covered? 

Your client is sued for an accident on an adjoining property where he has parked a trailer but didn't schedule it on his policy.  The insured doesn't own the land.  The insurance company denies the claim because of a Designated Premises clause included in the policy.

What does the ISO CG 21 44 - Limitation of Coverage to Designated Premises or Projects really do or not do to the policy?  Why are underwriters adding the endorsement?   Can you get them to remove it and how do you address this with your insureds?

More and more carriers are trying to narrow their exposures by using this endorsement or modifying their forms to try and have all the exposures enumerated and priced out under the policy.  How can you protect your insured - and yourself?

Participants will:

  • Learn why underwriters are using the Designated Premises endorsements. Does the endorsement really exclude all situations?
  • Understand what the wording "…operations necessary or incidental to those premises;" means and what various court cases have concluded.  Be aware of the difference in the ISO form versus any proprietary wording found in other carrier forms.
  • Be able to discuss with the underwriter a better way to handle their concerns, remove the endorsement and avoid claim problems before they arise.
