Quick Overview

Most of us are aware of the importance of providing "discrimination" coverage for our business clients and need to check carefully if the Personal Injury section of the CGL includes coverage and how it is defined. But what about Third Party Discrimination... are you providing that coverage, as well?

Substantial attention is paid to the employer-employee relationship and the important of providing "discrimination" coverage under the EPLI policy. But what about Third Party Discrimination suits arising out of:

  • Temporary employment
  • Leased employment
  • Vendors at your insured's location
  • Customers at your insured's location

This is the "forgotten" coverage that CAN be included on the EPLI by endorsement.

  • Third Party Discrimination coverage matters to YOU because these lawsuits continue to rise and there is NO coverage unless the policy automatically provides protection or by endorsement
  • Third Party Discrimination coverage matters to your INSUREDS because when the lawsuit is filed they will be looking to their policy or to you for coverage

Your E & O coverage cannot be the coverage of last resort.
